Partner Programme Agreement

This agreement is between you and Bufetico, and it covers taking part in the partner programme. It is separate from the Terms of Service, which cover using Bufetico as a subscriber and which continue to apply to you.

You accept this agreement when you apply to the programme. Applying does not make you a partner: see Section 1.

1. Applying and being accepted

Anyone with a Bufetico account can apply. We review each application and decide, and we may decline without giving a reason.

You are a partner from the moment we approve you, and not before. Until then your code is not active, it gives nobody anything, and you earn nothing. Do not promote it before we have told you that you are in.

2. Your code and your link

On approval we activate the code you chose and the link that goes with it. The code is what identifies the people you bring, so it has to reach them exactly as it is.

Anyone who subscribes through your link pays $1 for their first month, as described in Section 6 of the Terms of Service.

3. What you earn

You earn 40% of the amounts we actually receive from each customer you bring, for as long as that customer keeps paying.

It is a percentage and not a fixed amount, on purpose: if we change the price, your percentage applies to the new one and neither of us has to renegotiate anything.

The rate that applies when we approve you is yours for as long as you stay in the programme. We may offer a different rate to partners approved later.

On the 1st of each month we pay everything earned up to the end of the previous month, by the method recorded on your partner record.

Payments start at $50. If a month closes below that amount it carries over to the next one. Nothing is lost.

You are responsible for keeping your payment details current. We are not liable for money sent correctly to details you gave us.

6. Refunds and chargebacks

If a customer obtains a refund, or their bank reverses a payment, the commission for that payment is cancelled. If we had already paid it to you, it is deducted from your next payment.

7. Access to Bufetico

While you are an approved partner we give you access to Bufetico at no charge, so that you can use it and show it.

This access is part of the programme and not a subscription. It includes connecting a broker, as described in Section 7 of the Terms of Service. It ends when your participation ends. At that point, unless you have subscribed, the broker connection is removed, and so are the portfolios that come from that broker.

8. Staying in the programme

The free access exists so that you can promote Bufetico. To keep it, you need to be bringing customers.

For the first 90 days after approval nothing is required: that is time to prepare, publish and let your audience arrive. After that you need at least one customer who is paying. If you have none for 60 consecutive days, your participation ends.

The bar is having customers, not bringing new ones every month. A partner whose customers keep paying meets it without doing anything else.

A customer counts while their subscription is paid, including their $1 first month. Your own subscription does not count. A customer counts for the first link they arrived through. The 60 days only start counting once the first 90 are over.

If your participation ends, the link you shared keeps working for the people who find it: they still get their $1 first month, and no commission is paid on them.

Your account is not deleted. You stop being a partner and lose the free access, and you become an ordinary user again. Your portfolios, your history and any commission you already earned are unaffected, and you may apply again at any time.

9. What you have to say

Wherever you share your link, you must make clear that it is an affiliate link and that you are paid if someone subscribes through it.

Several countries require this. It is your responsibility to comply with the rules that apply where your audience is, including the disclosure rules of the platforms you publish on.

10. What you must not do

If you do any of this we may cancel the commissions affected and end your participation.

11. Our name and our logo

While you are a partner you may use the Bufetico name and logo for the sole purpose of promoting Bufetico, as we supply them and without altering them.

That permission is limited, non-exclusive and revocable. It gives you no rights over the marks, all goodwill from your use belongs to us, and it ends when your participation ends.

12. You are independent

Taking part in the programme does not make you an employee, an agent, a representative, a franchisee or a legal partner. You decide how you promote Bufetico, you have no authority to make commitments on our behalf, and you are responsible for what you publish.

13. Taxes

What you earn is your income. You are responsible for declaring it and paying any tax due where you live.

If the law that applies to us requires information or a form from you, we will ask you for it and we may hold payment until we have it.

14. Liability, law and disputes

Sections 13 to 15 of the Terms of Service (no warranty, limitation of liability and indemnity), Section 19 (governing law) and Section 20 (dispute resolution, arbitration agreement and class action waiver) apply to this agreement in the same way as they apply to your use of Bufetico, and are incorporated here by reference.

Read Section 20 before you apply. It affects how any dispute between us is resolved, including your right to go to court and to take part in a class action, and it explains how to opt out within 30 days.

15. Ending your participation

Either of us may end your participation at any time, by telling the other.

If you leave, or we end it, commission already earned and not reversed is paid on the next cycle and nothing further accrues. Sections 6, 11, 12, 13 and 14 survive.

Ending your participation does not close your Bufetico account. That is covered by Section 16 of the Terms of Service.

16. Changes

We may change this agreement and the programme, including the rate offered to new partners. If a change materially affects you we will tell you by email before it takes effect, and continuing in the programme after that means you accept it.

A change to the rate does not apply to commission already earned.
